Terms of Service

These terms govern your use of HACKUP ("the platform", "the service"), a learn-to-code platform operated by Arthur Joubin ("we", "us", "our"). By creating an account or using HACKUP, you agree to these terms.
1. Service
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied:
- Features may be added, changed, or removed without prior notice.
- The service may experience downtime, bugs, or data loss.
- We reserve the right to modify the XP system, restructure courses, or change features.
2. Accounts
To use HACKUP, you must create an account via Google OAuth or email registration. You agree to:
- Provide accurate information during registration.
- Keep your account credentials secure. You are responsible for all activity under your account.
- Not create multiple accounts to manipulate leaderboards, XP, or any other platform feature.
- Not share your account with others.
You must be at least 16 years old to create an account.
3. Acceptable Use
When using HACKUP, you agree not to:
- Submit malicious code designed to harm the platform, other users, or third-party services.
- Attempt to exploit, overload, or reverse-engineer the platform or its API.
- Use the AI chat tutor to generate content unrelated to learning (e.g., spam, harmful content, or content that violates any law).
- Abuse the AI features by circumventing rate limits or automating requests.
- Harass, impersonate, or harm other users.
- Use the platform for any unlawful purpose.
4. Subscriptions & Billing
HACKUP offers a free tier and a paid Builder subscription:
- Free tier: Read all lessons, save progress, earn XP and streaks.
- Builder ($9/month or $69/year): AI exercises, AI tutor, ranked code reviews, and developer tools.
Payments are processed by Stripe. By subscribing, you authorize recurring charges at the chosen interval.
- Cancellation: You may cancel at any time from your profile page or Stripe's customer portal. Access continues until the end of the current billing period.
- Failed payments: If a payment fails, you have a 3-day grace period while Stripe retries. After that, your account is downgraded to the free tier.
- Refunds: We do not offer prorated refunds for partial billing periods. If you believe you were charged in error, contact us at arthurjoubin@gmail.com.
5. Content Ownership
Our content
All course materials, lessons, exercises, UI design, and branding on HACKUP are owned by us or licensed to us. You may not copy, redistribute, or republish our course content without written permission.
Your content
You retain ownership of the code you write and submit on the platform. By submitting code for AI validation or chat interactions, you grant us a limited, non-exclusive license to process that code through our AI provider for the sole purpose of delivering the service (validation, feedback, hints). We do not claim ownership of your code submissions.
6. AI-Generated Feedback
HACKUP uses AI (powered by the DeepSeek API) to validate code, provide hints, and answer questions. You acknowledge that:
- AI-generated feedback may be inaccurate, incomplete, or misleading.
- AI responses do not constitute professional advice (technical, legal, or otherwise).
- You are responsible for reviewing and verifying any code or suggestions provided by the AI.
- We are not liable for decisions you make based on AI-generated feedback.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- HACKUP is provided without any warranty of fitness for a particular purpose, availability, or accuracy.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
- We are not liable for any loss of data, progress, or account information.
- Our total liability for any claim related to the service shall not exceed the amount you have paid us in the 12 months preceding the claim.
8. Termination
You may stop using HACKUP at any time. To delete your account and associated data, contact us at the email below.
We may suspend or terminate your account if you violate these terms, abuse the platform, or for any reason related to the operation of the service. Where possible, we will provide notice before termination.
9. Changes to These Terms
We may update these terms as the platform evolves. Significant changes will be communicated via a notice on the platform. Continued use of HACKUP after changes take effect constitutes acceptance of the new terms. If you disagree with updated terms, you should stop using the service.
10. Governing Law
These terms are governed by and construed in accordance with the laws of France. Any disputes arising from these terms or your use of HACKUP shall be subject to the exclusive jurisdiction of the courts of France.
